Tax Sales for Delinquent Tax

 

OCTOBER CERTIFICATE SALE

 

PLEASE NOTE: Due to the passage of Senate Bill 1770 on April 25, 2008 , there will be no more October Tax Certificate Sales.  

This senate bill eliminated the tax certificate sale. The law applies to all counties in the State of Oklahoma .

The June Resale (see below) is the only tax sale we will have for properties with delinquent tax.

If properties are acquired by the county at Resale, they may be subsequently purchased through a Commissioners Sale (see below).

 

JUNE RESALE

JUNE RESALE The Tax Resale is held the second Monday in June from 9:00 a.m. to 4:00 p.m., continuing from day to day, until the sale is completed. This sale consists of the remaining properties that have been through an October Tax Certificate Sale. By the resale date, most properties have at least four (4) years of delinquent tax. This sale is an out-right sale of the property to the highest bidder. The treasurer completes all notification and advertising requirements prior to the sale. A Resale Tax Deed is delivered to the successful purchaser. *Note: The owner can still redeem the property until the deed is properly filed in the County Clerk’s Office.*

Any properties purchased at this sale should be carefully examined prior to the sale. Once the sale is completed, it is final and there will be no refunds. If the property includes a mobile home, the purchaser assumes the responsibility to acquire a title to the mobile home. If a property is improved (has a home on it), the purchaser has the responsibility to execute an eviction of the occupant.

 

COMMISSIONERS SALE

Any property acquired by the county under the provisions of the resale tax laws may be sold by the county treasurer, after notice by publication, at such price as may be approved by the board of county commissioners, said notice to be given after receipt of bid on such property.

A written bid is submitted to the county treasurer for consideration by the board of county commissioners. The treasurer presents the bid to the commissioners and receives a verbal approval or rejection of the same. If approved, the bidder is contacted and must place on deposit with the county treasurer an amount sufficient to cover the bid amount and estimated costs of advertising and recording. Deposit must be made in cash to the county treasurer.

The treasurer sets a sale date, and then publishes a notice of the sale once during each of the three (3) consecutive weeks preceding the sale.

On the date of the sale, the treasurer sells the property to the highest competitive bidder, for cash in hand, or to the original bidder if there be no higher price offered.

The transcript of the proceedings of the sale is then presented to the board of county commissioners for their approval. If approved, the commissioners execute a deed to the successful purchaser. The cost of said advertisement and other expense incident to said sale shall be paid by the successful purchaser in addition to the amount bid upon said real estate.
